Expulsion – is the act of removal of a foreigner and/or a stateless person from Georgia, in accordance with the Law of Georgia “On the Legal Status of Aliens and Stateless Persons”.
An authorized body of the Ministry of Internal Affairs of Georgia shall examine the issue of removing a foreigner from Georgia within 10 business days subsequent to detecting the grounds for removal.
In case an authorized body of the Ministry of Internal Affairs of Georgia lodges the motion for expulsion with the court, the judge shall issue an order on removing a foreigner from Georgia or renders a decision on rejecting the motion. The Judge shall review a motion submitted by an authorized body of the Ministry of Internal Affairs of Georgia within 30 days subsequent to submission.
The foreigner shall have the right to submit his/her opinion to the court in writing and case materials regarding removal from Georgia within 72 hours after receiving the respective notification.
The decision on removing a foreigner from Georgia may be appealed to the Tbilisi City Court within 10 days after the foreigner has been notified of the decision on removal.
An order of the court on removing a foreigner from Georgia may be appealed to the Court of Appeals.
