Strategic Litigation
Strategic Litigation is one of the key areas of activity for Rights Georgia.
It involves handling cases at both local and international organizations aimed at addressing systemic issues in legislation and practice.
Rights Georgia was the first Georgian organization to file (in 1999) and win cases at the European Court of Human Rights. The organization established a precedent for reopening investigations and reviewing court decisions based on the judgments of the European Court.
The organization also introduced the standard for initiating proceedings in UN treaty bodies. Rights Georgia is the first organization from Georgia to file and win a case at the UN CEDAW Committee. This is the only decision where the Committee ceased monitoring due to full implementation.
Projects implemented under the strategic litigation direction include:
-
Empowering women, especially those belonging to ethnic minority groups, and promoting access to justice (2016–2017).
- Strategic litigation to protect fundamental human rights (2015).
- Strategic litigation to protect the right to health (2012–2013).
- Strategic litigation in the Caucasus (2006–2009).
- Strategic litigation within the country: introducing international mechanisms for the protection of human rights (2004–2007).
